11.11.09 – Change in Fishing Policy

Austin Lakes South residents,
In the next couple of weeks, you will notice that new signs will be installed at three lakes near the entry to our neighborhood. These signs reflect a new policy that was adopted by the board at our Sept. 15 meeting. After much discussion, and a unanimous vote by the members, it was decided that fishing privileges would be rescinded. This is not a decision we took lightly. However, over the past couple of years, we have continued to receive an increasing number of complaints from those whose homes are adjacent to the lakes, as well as other homeowners. Following is a list of many of the relevant issues:

  • People who fish on the lakes frequently do so outside of the common areas, directly in back of residents homes.
  • Some of these people do so for inordinate lengths of time, including before dawn and after dusk.
  • When asked to fish elsewhere, some have become belligerent, even threatening to homeowners.
  • Some leave trash, fishing line, bobbers, hooks, etc. along the shore. This is unsightly and poses a risk to homeowners and the mowing crew.
  • Some drive vehicles to the lakes, parking them along the road or in the grass, which creates traffic issues.


The Austin Lakes South Covenants do not grant fishing rights to residents. Over the years, the Association has granted them this privilege. Unfortunately, due largely to the actions of a likely small group of individuals, this privilege must be revoked for everyone.

Residents who wish to fish should do so at the lake just West of Nicole Boulevard, adjacent to the soccer fields. If you have any questions about this or any other Association business, please send an e-mail to Kevin Drew, who is the Austin Lakes South Property Manager for Kirkpatrick Management Company (kdrew@ekirkpatrick.com). He will bring questions or concerns before the board at our next quarterly meeting. All residents are encouraged to attend our annual Spring Meeting (normally in April of each year). When a date is set for that meeting, it will be posted on this site.

09.27.05 – Fall Meeting Information

When:
Saturday, October 29, 2005 – 9:30 a.m. - 11:30 a.m.

Washington Township Public Library – 498 North S.R. 267, Avon

It is very important that all residents attend this meeting. We will be voting on hiring a property management company in order to take over the management of the Austin Lakes South neighborhood. In addition, the prospective management company, Kirkpatrick Management, will be at the meeting and will be able to answer any questions or concerns you might have.

As many of you are aware the Association has operated without all officer positions being filled for many months. We cannot continue to operate this way. We must either have all vacancies filled or hire a management company. We have requested that people volunteer to fill various officer and committee positions at the past two meetings and continue to find it hard to get volunteers to come forward. There are many maintenance and repair projects, as well as, officer positions that need to be headed by our homeowners.

Your neighborhood dues will increase if an outside agency is hired. However unless people come forward to fill the necessary vacancies, the current officers must take that next step in order to keep Austin Lakes South a respectable and clean community. Please plan to attend the meeting in order to cast your vote on this very important issue.
In addition, even if the majority vote is to not use an outside agency we will be forced to take this action if no volunteers come forward to fill the necessary vacancies. If you have been thinking about stepping up and helping your community, now is the time. All Positions are available at this time. The Association must have a President, Secretary and Treasurer at a minimum.

If you are unable to attend the meeting and would like to cast your vote, please print a copy of this page and use the ballot at the bottom of this letter. Remember, you must be in good standing with your Association dues and in full compliance with bylaws in order to cast a vote. The Association must receive the ballot back no later than 10/22/2005 in order for your vote to count.

• President Selection – The current president, Jeff Hyde, will be vacating the position due to a move outside of the neighborhood. The vice-president, treasurer and secretary plan to remain in their current positions, but it is imperative that the presidency be filled. Our alternative is to turn the Association functions over to a Property Management company which would result in an increase in dues of over 40%. No experience is required. Just a concern for the well-being of our neighborhood.

• Open Floor – If you have a problem or concern that you wish to discuss, please be prepared to offer possible solutions and/or be willing to work with one of the officers to rectify the issue. This is your neighborhood, and we need your involvement.


8.11.04 – Hospital Sign Variance Requested

Sign by Design recently sent a registered letter to the Austin Lakes Homeowners Association informing us that the new Hospital has requested a variance for signage at 8224 East Rockville Road, near North County Road 800 East. The application and all plans pertaining to the variance are available for examination at the Office of the Planning and Zoning Department at the Avon Town Hall. The Town Hall is located at 6570 East U.S. Highway 36 and is open Monday through Friday between 8:00 a.m. and 4:00 p.m.

Written objections to this proposal must be filed with the Plan Commission Staff by August 15 at the Avon Town Hall at the above listed address.

The Avon Board of Zoning Appeals will hold a public meeting on this proposed special exception in the Avon Town Hall on August 19 at 7:00 p.m.

2003 Budget Update – Review of current savings and checking account balances.

Liens on homes for 2003 dues – In an effort to stem the tide of non-payment, we were forced to place liens on 25 homes. This number represents over 10% of the homes in Austin Lakes South. If you had a lien placed on your home and wish to have it removed, please contact us at austinlakes@hotmail.com to find out the amount owed (including past dues, late fees, attorney fees, and interest).

Dues Increase – As approved at the 2003 Fall meeting, the dues for 2004 will be $72, up $5 over 2003.

Officer Selection – At the last meeting, Jeff Hyde agreed to transition his way into the presidency, succeeding Randy Hawley. However, no one was willing to step up and assume the responsibilities of vice-president, secretary or treasurer. It is imperative that people fill at least the four officer positions in the Association. Otherwise, our only alternative is to turn over management of the neighborhood to a Property Management company. To that end, we have contacted a few companies and requested bids to manage day-to-day association matters for Austin Lakes South. The least expensive was Affordable HOA Management Services, which will charge at least $7000 per year. If we are unable to fill all officer positions at this meeting, we will sign with them, which will result in an increase in dues of over 40%.

Establish Dates for 2004 Yard Sale and Spring Clean Up – We will select dates for both of these events and ask for volunteers for the latter to help clean up the park and front wall/entrance area.

Open Floor – If you have a problem or concern that you wish to discuss, please be prepared to offer possible solutions and/or be willing to work with one of the officers to rectify the issue. This is your neighborhood, and we need your involvement.


 

12.02.03 – Liens

After sending multiple notices throughout the calendar year, we have had to place liens on approximately 24 properties in Austin Lakes South for non-payment of 2003 dues. With the addition of a $10 late fee, each of these properties owes at least $77 resulting in a total shortfall $1848.00 for the year.

In addition to the back dues, the owner of each property on which a lien has been placed will have to pay all legal fees associated with filing and removing the lien and 18% interest per year until the lien is removed. The respective homes cannot be sold until the liens are paid in full.

This is a most unfortunate situation, but in order to be fair to the other 210 homeowners in Austin Lakes South who faithfully pay their dues, the liens have become necessary.

Any homeowner, on whose property a lien has been placed, who wishes to have it removed is urged to visit the Officer & Contact Info page to initiate this process.


 

10.21.03 – Street Paving

According to Ryan Cannon, the Town of Avon Public Works Manager, Globe Asphalt Paving will be resurfacing many of the streets in Austin Lakes. The letter, which the town recently distributed states that any vehicle in the street will be towed at the owner's expense. It is also important to note that, according to Avon Town Code (6-8-75) that "it is unlawful for any person to park, store or permit to be parked or stored, any automobile trailer, boat trailer, house trailer or semi-tractor trailer on any street or alley."

09.03.03– Tree Trimming and Muskrat Trapping Update

The Bradford Pear trees that line the median at the U.S. 36 entrance to Austin Lakes have been thinned and trimmed. This should make it easier to get in and out of the neighborhood if you drive a tall vehicle, and should extend the lifespan of the trees as well.

Muskrat traps were placed in each of the ponds in late August by a professional trapping company to try and stop the damage to the banks of the ponds. These traps will be in place for the next couple of weeks. Our apologies for the delay, but muskrats appear to be a growing problem in the area (not just Austin Lakes), so the demand for the trapping companies has been high.


 

08.19.03– Entrance and Park Maintenance Update

We have just completed some significant work to improve the appearance of our neighborhood including the following:

Park
• Installation of new basketball goal and permanent bench.
• Weeding of entire park area
• Spreading of new mulch over park area

Front Wall
• Removal of dead bushes
• Planting of new bushes
• Trimming and spraying of all exiting bushes
• Spreading of new mulch over entire area, including median

The Association would like to thank those who helped in these efforts including Holly Giles, Ruth and Ernie Forster, Mark Fleenor, and anyone else who volunteered their personal time to these projects.

Future Help Needed
Any resident who can help maintain the front wall area, please contact the Association as soon as possible. In order to keep costs down, we are trying to avoid having to contract this work out, but if no one steps up, we will have to look at doing so in the spring.

07.09.03 – Proposed Rental Covenant Update

As many of you know, a new covenant which deals with rental properties has been proposed. Over the past few weeks, represtatives of the Homeowners Association have been canvassing the neighborhood to obtain proxy votes for, against the new covenant. The final vote will be taken at the upcoming meeting on July 19. You may contact one of the officers if you have any questions.


 

06.01.03 – Clean Up Day – Thank You

The officers of the Homeowners Association would like to say "thank you" to the people who helped (or showed up to help) for Clean Up Day on May 31. The front entrance area and playground look great. Also, a special thanks to Dan Anosky for getting the missing "A" replaced in the sign on the front wall.

05.01.03– Reminder about Neighborhood Clean Up Day

Saturday, May 31 – Rainout day will be Sunday, June 1 Please meet at the park at 9:00 a.m. Saturday (or 12:00 p.m. if on Sunday). Bring rakes, garden gloves, hand trowels, and trash bags to rake and clean up the park, front wall, median and retention pond areas. In the past, cleanup has only taken a couple of hours. Your help will be greatly appreciated.

04.23.03– Launch of New Web Site

The creation of an official web site for the Austin Lakes South Homeowners Association seemed a logical first step to better communication with residents of the edition. We understand that there are some residents who do not have internet access. Therefore, hard copies of all important communications regarding annual meetings, dues payments, etc. will be sent via U.S. mail, as well as posted here.

We hope that you will find this site to be a useful resource for news and events regarding our neighborhood. Please bookmark the site and check back every now and then to find out what's going on, and what's coming up. Thanks.


04.23.03– Notice Regarding Parking on the Street

The Austin Lakes Homeowners Association has tried to enforce the bylaws that govern all residents this edition judiciously. These bylaws were developed in order to help maintain overall property values and the aesthetics of the neighborhood. Over the past few months, we have received an increasing number of complaints regarding the parking of vehicles on the street (Bylaw No. 20)

While it may be necessary for residents to park one of their cars on the street for short periods of time, it has become all too common for some residents to use the street as the primary parking area for their vehicles. All homes in Austin Lakes have at least a two-car garage, and space in the driveway for at least two additional cars.

Please note the following reasons why cars should not be parked in the street unless absolutely necessary:

• The Avon Police Department stongly recommends keeping cars off of the street to ensure the safety of the many children in the edition. We have had a few occasions where children have nearly been hit while emerging from behind a parked car.

• We have received a complaint from the U.S. Postal Service regarding the ability of mail carriers to access some mailboxes.

• With winter approaching, it is important to keep cars off the street to facilitate snow removal.

• It is a violation of our Covenants.
